4. Contact
When you contact us (e.g. via contact form, email, telephone or social media), personal data is collected. Which data is collected when you use a contact form can be seen in the respective contact form. 5. Data processing when opening a customer account and for contract processing
We process our customers' data as part of the ordering process in our online shop in order to enable them to select and order the selected products and services, as well as to pay for them and to deliver or execute them.
The data processed includes inventory data, communication data, contract data, and payment data. The data subjects include our customers, prospective customers, and other business partners. The processing is carried out for the purpose of providing contractual services within the scope of operating an online shop, billing, delivery, and customer services. We use session cookies to store the shopping cart contents and permanent cookies to store the login status.

Processing is based on Art. 6 (1) (b) (execution of order transactions) and (c) (legally required archiving) GDPR. The information marked as required is necessary to establish and fulfill the contract. We only disclose this data to third parties in the context of delivery, payment, or within the scope of legal permissions and obligations to legal advisors and authorities. Data will only be processed in third countries if this is necessary to fulfill the contract (e.g., at the customer's request during delivery or payment).

Users can optionally create a user account, which allows them to view their orders, in particular. During registration, the required information is communicated to users. User accounts are not public and cannot be indexed by search engines. If users cancel their user account, their data will be deleted, unless retention is necessary for commercial or tax law reasons in accordance with Art. 6 (1) (c) GDPR. Information in the customer account remains until it is deleted and subsequently archived in the event of a legal obligation. Deletion occurs after expiry of statutory warranty and similar obligations; the necessity of retaining the data is reviewed every three years; in the case of statutory archiving obligations, deletion occurs after their expiry (end of commercial (6 years) and tax (10 years) retention period).


6. Use of your data for direct marketing
6.1 Registration for our email newsletter

Providing any other data is voluntary and will be used to address you personally. We use the so-called double opt-in procedure to send the newsletter. Our email newsletter is sent via the technical service provider Omnisend (www.omnisend.com), to whom we share the data you provided when registering for the newsletter. This sharing occurs in accordance with Art. 6 (1) (f) GDPR and serves our legitimate interest in using an effective, secure, and user-friendly newsletter system. Please note that your data is generally transferred to an Omnisend server in the USA and stored there.
Omnisend uses this information to send and statistically evaluate the newsletter on our behalf. For evaluation purposes, the emails sent contain so-called web beacons or tracking pixels, which are single-pixel image files stored on our website. This makes it possible to determine whether a newsletter message has been opened and which links have been clicked. Technical information is also recorded (e.g., time of retrieval, IP address, browser type, and operating system). 7. Data processing for order processing
7.1 To process your order, we work with the following service providers, who support us in whole or in part in the execution of concluded contracts. Certain personal data will be transmitted to these service providers in accordance with the following information. The personal data we collect will be passed on to the transport company commissioned with the delivery as part of the contract processing, insofar as this is necessary for the delivery of the goods.

The data processed by the payment service providers includes inventory data such as name and address, bank details such as account numbers or credit card numbers, passwords, TANs and checksums as well as contract, amount and recipient-related information. This information is required to carry out the transactions. However, the data entered is only processed and stored by the payment service providers. This means that we do not receive any account- or credit card-related information, only information confirming or rejecting the payment. LSM Fulfillment GmbH

We also use the "Custom Audiences from File" process of the social network Facebook, Inc. In this case, the email addresses of newsletter recipients are uploaded to Facebook. The upload process is encrypted. The upload serves solely to determine recipients of our Facebook ads. We want to ensure that the ads are only displayed to users who are interested in our information and services.

If you send us a personal message via Facebook and grant us permission, we will use personal messages to inform you about STREET SOUP news, such as new products and special offers. Google Marketing Services allow us to display advertisements for and on our website in a more targeted manner in order to only present users with ads that potentially match their interests. If, for example, a user is shown ads for products they were interested in on other websites, this is referred to as "remarketing". For these purposes, when you visit our website and other websites on which Google Marketing Services are active, Google immediately executes a code from Google and so-called (re)marketing tags (invisible graphics or code, also known as "web beacons") are integrated into the website. With their help, an individual cookie, i.e. a small file, is stored on the user's device (similar technologies can also be used instead of cookies). Within the framework of Google Analytics, we inform you that the IP address is shortened within member states of the European Union or in other contracting states to the Agreement on the European Economic Area and only in exceptional cases is it transmitted in full to a Google server in the USA and shortened there. The IP address is not merged with user data within other Google offerings. Google may also combine the above-mentioned information with information from other sources. If the user subsequently visits other websites, advertisements tailored to their interests can be displayed.

User data is processed pseudonymously within the framework of Google Marketing Services. This means that Google does not store and process the user's name or email address, for example, but processes the relevant data cookie-related within pseudonymous user profiles. This means that from Google's perspective, the ads are not managed and displayed for a specifically identified person, but for the cookie owner, regardless of who this cookie owner is. This does not apply if a user has expressly permitted Google to process the data without this pseudonymization. The information collected about users by Google Marketing Services is transmitted to Google and stored on Google's servers in the USA.

The Google marketing services we use include the online advertising program "Google AdWords." With Google AdWords, each AdWords customer receives a different "conversion cookie." Cookies cannot be tracked across AdWords customers' websites. The information collected with the help of the cookie is used to compile conversion statistics for AdWords customers who have opted for conversion tracking. AdWords customers learn the total number of users who clicked on their ad and were redirected to a page with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users.

12.1 The applicable data protection law grants you comprehensive rights as a data subject (rights of information and intervention) vis-à-vis the controller with regard to the processing of your personal data, about which we will inform you below:
In particular, pursuant to Art. 15 GDPR, you have the right to information about your personal data processed by us, the processing purposes, the categories of personal data processed, the recipients or categories of recipients to whom your data have been or will be disclosed, the planned storage period or the criteria for determining the storage period, the existence of a right to rectification, erasure, restriction of processing, objection to processing, complaint to a supervisory authority, the origin of your data if it was not collected from you by us, the existence of automated decision-making including profiling and, if applicable, meaningful information about the logic involved and the scope and intended effects of such processing concerning you, as well as your right to be informed of the guarantees in place pursuant to Art. 46 GDPR when your data is transferred to third countries;
According to Art. 16 GDPR, you have the right to request that the data concerning you be completed or that inaccurate data concerning you be corrected.
In accordance with Art. 17 GDPR, you have the right to request that the data in question be deleted immediately or, alternatively, to request that the processing of the data be restricted in accordance with Art. 18 GDPR.
You have the right to request that we receive the data concerning you that you have provided to us in accordance with Art. 20 GDPR and to request that it be transmitted to other responsible parties.

12.2 RIGHT OF OBJECTION
If we process your personal data based on our overriding legitimate interest within the framework of a balancing of interests, you have the right to object to this processing at any time with future effect for reasons arising from your particular situation.

13. Duration of storage of personal data
The data we process will be deleted or restricted in accordance with Articles 17 and 18 of the GDPR. Unless expressly stated in this privacy policy, the data stored by us will be deleted as soon as it is no longer required for its intended purpose and there are no statutory retention periods that prevent deletion. If the data is not deleted because it is required for other legally permissible purposes, its processing will be restricted. According to legal requirements in Austria, storage takes place in particular for 7 years in accordance with Section 132 Paragraph 1 BAO (accounting documents, receipts/invoices, accounts, receipts, business papers, statements of income and expenditure, etc.), for 22 years in connection with real estate and for 10 years for documents in connection with electronically provided services, telecommunications, radio and television services that are provided to non-entrepreneurs in EU member states and for which the Mini One Stop Shop (MOSS) is used.

We process data as part of administrative tasks and to organize our operations, financial accounting, and to comply with legal obligations, such as archiving. In doing so, we process the same data that we process as part of providing our contractual services. The processing is based on Art. 6 (1) (c) GDPR and Art. 6 (1) (f) GDPR. Customers, interested parties, business partners, and website visitors are affected by the processing. The purpose of and our interest in the processing lies in administration, financial accounting, office organization, and data archiving—i.e., tasks that serve to maintain our business activities, perform our duties, and provide our services. The deletion of data for contractual services and contractual communication corresponds to the information provided for these processing activities.
We disclose or transmit data to the tax authorities, consultants such as tax consultants or auditors as well as other fee offices and payment service providers.

Furthermore, based on our business interests, we store information about suppliers, event organizers, and other business partners, e.g., for the purpose of later contact. We generally store this mostly company-related data permanently.


15. Business analyses and market research
In order to operate our business economically and to identify market trends and customer and user wishes, we analyze the data available to us on business transactions, contracts, inquiries, etc. In doing so, we process inventory data, communication data, contract data, payment data, usage data and metadata on the basis of Art. 6 (1) (f) GDPR, whereby the data subjects include customers, interested parties, business partners, visitors and users of the online offer.
The analyses are conducted for the purposes of business evaluations, marketing, and market research. We may consider the profiles of registered users with information, for example, about the services they have used. The analyses help us increase user-friendliness, optimize our offerings, and improve business efficiency. The analyses serve our sole purpose and will not be disclosed externally unless they are anonymous analyses with summarized values.
If these analyses or profiles are personal, they will be deleted or anonymized upon user termination, otherwise after two years from the conclusion of the contract. Otherwise, the overall business analyses and general trend determinations are created anonymously wherever possible.
